Youngevity WINS MOST OF LAWSUIT AGAINST FDA

Washington, D.C.: The U.S. District Court for the Southern District of California handed FDA a pyrrhic victory on March 29, 2005, granting in part and denying in part FDA’s motion to dismiss and for summary judgment in Wallach v. Crawford. Joel D. Wallach, D.V.M., N.D. and Youngevity, Inc. sued the FDA in federal Court on February 3, 2004, alleging that the so-called “third party literature” section of the Dietary Supplement Health and Education Act (DSHEA) (21 U.S.C. 343-2(a)) was an unconstitutional restriction of free speech because it did not permit the unfettered dissemination of the Physician Desk Reference (PDR) section on magnesium to consumers by dietary supplement companies. FDA Postpones Decision on Lycopene/Cancer Health Claim for a Fourth Time

6/27/2005 San Diego, California - The FDA has requested a fourth extension on giving a decision on Youngevity’s health claim petition on the link between lycopene and a reduced risk of developing certain types of cancer until August 12, 2005.

San Diego, California - The FDA has postponed its decision on the pending Youngevity health claim petition on the link between lycopene and a reduced risk of developing certain types of cancer until June 13, 2005. This is the third extension for this petition requested by the agency. The FDA was supposed to issue its decision on December 24, 2004, then extended its deadline until February 11, 2005, again until April 12, 2005 and now have asked for an additional 60 day extension. FDA postpones decision on Lycopene and cancer health claim petition until February 11, 2005

12/16/04 San Diego, California - The FDA will not issue its decision on the pending Youngevity lycopene/cancer health claim petition until February 11, 2005. The FDA was supposed to issue its decision on December 24, 2004. In recent months the agency has asked for extensions in its review of seven other pending qualified health claim petitions citing a lack of agency resources.
